7. Legal Bases for Processing: EEA and UK

Where EU GDPR or UK GDPR applies, we rely on: Contract (to provide Services, manage your account and process subscriptions and payments); Legitimate Interests (such as improving and securing CAMCESS, preventing fraud, managing business relationships and B2B communications, after considering the impact on individuals); Consent (where required; you may withdraw it at any time without affecting prior processing); and Legal Obligation.

8. Cookies, Analytics and Marketing

We use essential cookies for authentication and security and, where permitted and with consent where required, functional and analytics cookies on our website to understand usage and improve performance. You can manage cookies through your browser or our cookie controls. See our Cookie Policy. Cookies, analytics and marketing tools are not used to collect, profile or target using Google user data.

We may contact you by email, telephone, SMS, messaging platforms or in-product notifications. You can unsubscribe from promotional emails using the link in the message or by contacting us. We may still send transactional communications needed to provide the Services, manage accounts, process payments, send security notices or comply with law.

9. Customer Data and CAMCESS SaaS Customers

CAMCESS provides business customers with tools that may process information about their customers, employees, prospects and other individuals, such as names, contact details, account information, product usage, communications, health scores, success plans, renewal and billing information, survey and review information, and stakeholder information uploaded or connected by the customer. When we process this information solely on behalf of a business customer, we generally act as a Processor or Service Provider and the customer controls the purposes and means of processing. Privacy requests about that information should be directed to the customer.

10. AI and Automated Processing

CAMCESS may offer AI-powered features including churn-risk analysis, health recommendations, sentiment analysis, meeting and account summaries, success-plan and task recommendations, forecasting and classification. AI outputs may be inaccurate, incomplete, outdated, misleading or inappropriate and should be reviewed before being relied upon; CAMCESS does not guarantee their accuracy.

CAMCESS does not use identifiable customer data submitted by a business customer to train publicly available third-party AI models unless the customer expressly authorizes it. As stated in section 4.5, Google user data is never used to train generalized or non-personalized AI or machine learning models. We may use third-party AI infrastructure and model providers as subprocessors, and the applicable DPA and subprocessor arrangements govern that processing.

11. International Data Transfers

CAMCESS is operated from India and uses service providers and infrastructure in other countries, so personal information may be processed outside your country. Where required, we use appropriate safeguards such as the EU Standard Contractual Clauses and the UK International Data Transfer Agreement or UK Addendum. Further detail on transfers of Customer Data is in the CAMCESS Global DPA.

12. How Do We Protect Personal Information?

CAMCESS maintains technical, administrative and organizational safeguards including access controls, authentication, encryption, monitoring, logging, secure infrastructure, vulnerability management, employee confidentiality obligations, backups, incident response and access reviews. See also Security Practices. No system can be guaranteed to be completely secure, and you are responsible for keeping your credentials and devices secure and for using multi-factor authentication where available.

13. Data Retention

We retain personal information only as long as reasonably necessary for the purposes in this policy, or as the law requires. For example: account information while your account is active; billing records for applicable tax and accounting periods; marketing preferences until you change them; and support records for a reasonable operational period. Customer Data is retained according to the customer's instructions and agreement and deleted or returned after termination as described in our Terms. Google user data follows section 4.6. When information is no longer needed, we delete, anonymize or securely archive it.

14. Your Privacy Rights

Depending on where you live, you may have the right to access, correct, update, delete, restrict or object to our processing of your personal information, to withdraw consent, to data portability, to opt out of certain processing, and to complain to a regulator. This includes rights under the EU and UK GDPR, India's Digital Personal Data Protection Act, 2023 (including grievance redressal), and U.S. state laws such as the CCPA/CPRA. We do not sell personal information for monetary consideration, and we will provide legally required opt-outs where applicable law treats a disclosure as a "sale" or "sharing". We do not discriminate against you for exercising your rights.

How to Exercise Your Rights

Email [email protected] with your name, email address, country of residence, the nature of your request, and any information reasonably needed to verify your identity. Use the same address to request deletion of your Google user data. We will respond within the period required by law. If your data is held in CAMCESS by one of our customers, we may refer your request to that customer.

15. Do Not Track

There is no universally accepted standard for "Do Not Track" signals, so we may not respond to them in all circumstances. Where applicable law requires us to honor a recognized browser or privacy preference signal, we will.

16. Children's Privacy

CAMCESS is intended for business users and is not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.

17. Customer Portal, Reviews and Public Content

Customers may use CAMCESS to share information (such as mutual success plans, objectives, outcomes and tasks) with their own customers through a Customer Portal. Those customers decide what is shared, and their own privacy policies apply. If you submit reviews, testimonials or other content intended for public display, it may become publicly available.

18. Third-Party Services, Integrations and Social Media

CAMCESS may link to or integrate with third-party services such as Google, Microsoft, Zoom, LinkedIn, CRM, payment and analytics platforms. When you authorize an integration, CAMCESS may access information made available by it, and you are responsible for the permissions you grant. Third parties have their own privacy policies, and we are not responsible for their practices. Interactions with our social media pages are also governed by the relevant network's policies. Where customers record LinkedIn URLs or similar professional profile details, we process them under the customer's instructions and do not guarantee their accuracy.

19. Payments, Recruitment and Business Contacts

Payment information may be processed by CAMCESS and third-party payment providers; where a processor handles card details, we may not receive or store the full card number. If you apply for a job, we process your application details to evaluate and manage recruitment. If you interact with us as a supplier, partner, investor, advisor or other business contact, we process your professional information to communicate with you, perform contracts and maintain business records.

20. Data Breaches

If we determine that a breach involving personal information has occurred, we will take reasonable steps to investigate, contain, remediate and prevent recurrence, and notify affected parties and authorities where required by law. Where we act as a Processor for a customer, notification is generally handled under the DPA and the customer agreement.

21. Changes to This Privacy Policy

We may update this Privacy Policy when our practices, Services or the law change, and will revise the "Last Updated" date. We will notify you of material changes, including any change in how we access, use, store or share Google user data, by email or in the CAMCESS application, and will obtain your consent where required.

22. Governing Law

This Privacy Policy is generally governed by the laws applicable to CAMCESS and the relevant relationship with the individual, subject always to mandatory data protection laws that apply to that individual. Nothing in it limits rights that cannot legally be limited.
